Contact & Billing Information:
You must provide us with, and keep current, accurate contact information for you in the billing area and Cpanel/WHM dashboards. This includes but is not limited to E-mail addresses not based on the main domain of your account and telephone contacts. It is your responsibility to ensure the email address on file is current or up to date at all times. We are not responsible for any claim, damages, fees, or otherwise as a result of accounts terminated or suspended due to inaccurate or unusable contact information. Providing false contact information of any kind may result in the suspension or termination of your account. You can update this information at any time in your Cpanel/WHM dashboard, or in the billing login area.
While we maintain the highest standards and try for near instant account activations this is not always possible. Certain account types such as dedicated servers, virtual private servers, and reseller accounts require extra time to provision. At times additional fraud checks or information may be needed, and the client agrees to provide said information in a timely manner. We make no guarantees in regards to the speed in which an order is completed. Accounts will only enter the setup queue once we have received payment and screened the order for fraud. Accounts are then setup in the order they are paid, received, and screened. In certain cases such as dedicated or virtual private servers purchases and other high risk transactions, it may be necessary to provide government issued identification and a scan of the credit card used. If you fail to meet any requirements, the order may be canceled.
In certain cases where requested by the client we will transfer your data from the previous provider to our servers (for regular web hosting plans). It can only be done by transferring files from another Cpanel webhositng accounts. This will be done with our best efforts, however, we do not guarantee the transfer process. This courtesy service is done on an as requested and as available on a case-by-case basis. Each provider may use different software, configurations, and/or other variables which complicate or in some cases prevent a smooth transfer. We will provide free transfers when possible as long as the new environment and control panel are the same as the old host/server. We will advise you if your free move is not possible and what the rate will be if you wish us to proceed at that point. We do not guarantee the transfers will be successful, complete, or done in a certain period of time.
If we assign a Customer an Internet Protocol address for Customer’s use, the right to use that Internet Protocol address shall belong only to us, and Customer shall have no right to use that Internet Protocol address except as permitted by us at our sole discretion in connection with the Services, during the term of this Agreement. We shall maintain and control ownership of all Internet Protocol numbers and addresses that may be assigned to Customer by us, and we reserve the right to change or remove any and all such Internet Protocol numbers and addresses, in our sole and absolute discretion. Our allocation of IP addresses is limited by ARIN’s new policies.
For accounts that include "unlimited bandwidth", a large quota is entered into the system so most accounts will never come close to the max amount. You may request more bandwith when you have used 90% of your current allowance, if needed.
Clients may not use disk space for anything other than active hosting files, i.e., files needed for their actual website(s). It is not to be used to store other non-website data, backups, or archive files of any kind. No use of storing gaming files of any kind is permitted. Files must be used for the functioning of your website, be publicly accessible and linked to on your site.
Resellers (Reseller or Multi-Website Hosting Accounts) are responsible for supporting their own clients. We are happy to help you support your clients but all support requests must be made by the reseller on their clients’ behalf for security purposes. Resellers are responsible for all content stored or transmitted under their reseller account, clients accounts, and for the actions of their clients’. Resellers and their clients are liable to and responsible for adhering to all the terms in this agreement. Resellers may use the wording of our Terms Of Service on this page, as long as they remove all supremewebhosting.net or our company names.
SupremeWebHosting.net reserves the right to reset the password in the event a password on file does not work or we are unable to access your account, if we are directed to do so by law enforcement or to perform security audits. Clients must ensure the email, phone number, and passwords on file are current at all times. SupremeWebHosting.net reserves the right to audit servers to ensure a secure and safe network. Our traditional webhosting Cpanel accounts and VPS accounts are backed up daily in case of server failure. It's important to do your own local backups for your own needs as well. Dedicated servers are not backed up, so be sure to do your own.
Notice of method of communications:
SupremeWebHosting.net will communicate with clients via our online email contact form for all billing and support needs.
SupremeWebHosting.net reserves the right to change future pricing terms on any account and service at anytime. In some cases we have no control over third party licensing where prices can go up outside of our control. In those cases we will have to pass on the price increase on to you for future service renewals. We will never increase an existing webhosting account plan price during the current pre-paid period. However, addons such as domain registrations, WHMCS license fees, control panel fees for semi dedicated or dedicated servers, IP’s, SSL certificates, etc. are licensed from third parties and therefore are subject to change.
Billing and Payments:
You agree to pay SupremeWebHosting.net in advance for the services to be rendered. Subsequent payments are due on the anniversary date of your plans term. You agree that until and unless you notify us directly for cancellation for all services received, those services are considered active, billable, and will be billed on a recurring basis. Client agrees to pay recurring charges that are not canceled at least before the next renewal date. It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. We are not responsible for any fees accessed on the client by their paypal account or bank as a result of the client’s account being invoiced. Service will be suspended on accounts that are 3 days past due (shared hosting). Service suspended for nonpayment will remain so until the account balance or contract term is paid in full. Shared Hosting accounts who do not make payment within 5 days are subject to complete cancellation. For subscription payments, we accept credit card subscriptions for recurring orders and require automatic subscriptions to remain active. For customers who are using VPS or Dedicated Servers, your automated subscription must remain active (do not manually cancel). If you cancel your recurring billing, this acts as a notice to us if you intend to cancel services, and fail to pay your bill manually by the due date (in any form), your VPS or dedicated server is subject to immediate cancellation.
Any dispute to a credit card charge aka chargeback, wrongful or intentional, will result in a $50 administrative fee in addition to the disputed charge before service can be restored. We may request payment in cashiers check or money order before restoring service. All billing disputes must be reported within 30 days of the time the dispute occurred. SupremeWebHosting.net may temporarily deny service or terminate this Agreement upon the failure of client to pay charges when due. Such termination or denial will not relieve client of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees.
All cancellations must be sent using the contact us form. You must include your first name, main domain name or host name. Cancellations are effective the date the form is submitted unless otherwise requested. While there are no cancellation fees, you must cancel prior to your next billing cycle to prevent being re-billed. Payments made up to your cancellation date are not refundable. Remaining time left on any services already paid for is non-refundable. It is best to cancel just prior to your billing cycle end date. Any due or past-due balance on your account must be paid in full to cancel. This does not include any added support or service fees you have contracted us to provide.
Until an account is officially canceled, you are obligated to pay for your account even if you do not use it. It costs us on an ongoing basis to provision space, power, and bandwidth for services of our clients. We continue to provision those services for your use until you cancel with us therefore we can not always know if you are not using the space after we have provisioned it. Because we have provisioned services and provided you with details you have the ability to use your account. An unused account still allocates system resources that could be used for other customers.
If our internal collection efforts fail, SupremeWebHosting.net reserves the right to report the debt to credit bureaus or turn the account over to a 3rd-party collections agency or attorney for further action at clients expense. Client agrees to pay any and all collections fees, including a fee that is equal to the unpaid amount, which can double what you owe. Unpaid invoices may affect your credit rating.
There are no refunds whole or in part on: domain name registrations, shared hosting payments, reseller hosting payments, dedicated servers, semi-dedicated servers, service addons, IP fees, SSL certificates, software licenses, administrative fees, support or install fees. Month to month renewals and recurring payments are non-refundable in whole or in part once made. We do not pro-rate or refund for early cancellation or cancelling part way through your current pre-paid billing cycle. Client may request a cancellation date that matches the service end date, but make sure you cancel prior to the next billing date to avoid future charges.
While we all try to get along sometimes that’s a challenge. Please treat our staff and personnel as you would like to be treated yourself. While we are tolerant and understanding we too are human, please treat us as such. You agree to refrain from abusive and profane language on our systems, interfaces, public, and private communications. Abuse of our staff in any medium or form can result in the suspension or termination of your services without refunds.
You are responsible for any and all content in and under your site or account at all times. All services provided by us may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. Use of our services to infringe upon any copyright or trademark is prohibited.
We do NOT permit legal or illegal adult content on any of our hosting packages. All other services not listed here are forbidden to store, serve, or contain any adult content/nudity material. We reserve the right to determine the definition of “adult content” as it pertains to our services.
Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice. This includes but is not limited to unauthorized copying of movies, music, books, photographs, or any other copyrighted work. We do not allow any content that may be construed as offensive or illegal including, but not limited to pirated software, bit torrents, bitcoin (except dedicated servers), IRC, Proxies, hacker programs/archives, copyrighted MP3’s, Warez, copyrighted material, trademarks, child nudity or pornography or content perceived to be child pornography, or material protected by trade secrets and other statutes. Any site found to host perceived child pornography or linking to child pornography will be suspended immediately without notice and reported to authorities. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited on our systems.
Threats and unlawful conduct:
You may not use our service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property. Use of our services to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another company or individual may result in immediate suspension and possible permanent termination of your account(s).
Use of our service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as “pyramid schemes,” “ponzi schemes,” and “chain letters.” Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous re-mailers or nicknames does not constitute impersonation. Impersonation involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it.
Attacks and Exploits:
Any activity which affects the ability of other people or systems to use any services or other Internet services. This includes “denial of service” (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the client’s responsibility to ensure that their server is configured in a secure manner. A client may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. Unauthorized entry and/or use of another company and/or individual’s computer system will result in immediate account termination. We will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems.
Commercial Advertising Email aka (SPAM):
SupremeWebHosting.net maintains a zero tolerance spam policy and we adhere to it strictly. Spamming, or the sending of unsolicited email (sending email to someone who did not request it or has no business relationship with you), from one of our servers is STRICTLY prohibited and will qualify your site for immediate susension and ultimately deactivation with no refund.
Websites advertised via SPAM (Spamvertised) are also not permitted on our network. This includes, but is not limited to SPAM sent via fax, email, sendmail, instant messaging, or USENET/newsgroups or any other transmission of data to another. Any account which results in our IP space being blacklisted may be immediately terminated.
Sending Unsolicited Email ("spam") - The sending of any form of Unsolicited Bulk Email through our servers is prohibited. Likewise, the sending of spam from another service provider advertizing a web site, email address or utilizing any resource hosted on our servers is prohibited. Our services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.
Mailing Lists - Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run on our servers must be 100% opt-in. The subscription confirmation message received from each address owner must be kept on file in case of a spam complaint or IP blacklisting we receive. Purchasing lead lists of email addresses from 3rd parties for emailing from any of our servers is prohibited.
We will be the sole arbiter as to what constitutes a violation of this provision. Claims investigated by us about spam from any of our users or users of theirs, will be billed our usual hourly rate for such extra work. Any IP blacklisting that occurs by your use of email on our server, is your responsibility, and you agree to pay the costs for any clean up. The blacklisting clean up fee for such an instance will be determined by SupremeWebHosting.net based on how deep the blacklisting occurs, and will be no less than $500 per incident.
We do not allow programs to run continually in the background on shared hosting servers. You can run any legal daemons on your own VPS or Dedicated server except for IRC and Proxy services. This is to minimize system resources used and operational maintenance needed. IRC: We DO NOT allow IRC or IRC bots on our network. Proxy: We DO NOT allow proxy services on our network. Cron jobs used by software are ok as they are intermittent, as long as they do not cause to much draw on server resources in the case of shared hosting or VPS accounts.
We do not allow any php or sendmail software programs that are placed openly on your website, where anyone who visits your site can openly send email(s). These are usually for sending spam. We do not allow the installation of any such open mailing software. Clients who have this software installed will be suspended until the software is removed. Free accounts may be deleted immediately. Only email sending software that sends email directly and only from you or your installed server software that sends transaction emails in your behalf, or requires you to login to an email account is allowed.
Any attempts to undermine or cause harm to any Company server or customer of ours is strictly prohibited. We hold no responsibility for the use of our clients’ accounts. Any account that abuses resources and actions are not taken to desist, calls for immediate deactivation without any refund of payments made thus far. Any site using what we deem to be using excessive cpu cycles or any resources that cause strain to other sites may also be offered new terms. Use of our service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of our or another entity’s computer software or hardware, electronic communications system, or telecommunications system.
You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. Sharing your password and account access with unauthorized users is prohibited and you will be held responsible for such use. Attempting to obtain another user’s account password is strictly prohibited, and may result in termination of service. You may not attempt to circumvent user authentication or security of any host, network or account. Users who violate systems or network security may incur criminal or civil liability. We will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.
If our system administrators determine that a customer’s account is utilizing an unacceptable amount of system resources, we may temporarily suspend the account in question to preserve server integrity for other users. We may contact the client to offer alternative solutions for their accounts and make our best attempt to keep their account active without degradation to other clients services. Provider is the sole arbiter as to what constitutes a violation of this provision. Clients will not use more than 30% of a systems resources for longer than 1 minute or more than 150,000 inodes on any single shared or resold hosting account or 500,000 inodes reseller wide for reseller accounts. Virtual Private Servers may not utilize more than 1,000,000 inodes. Dedicated server customers are free to utilize 100% of their dedicated server(s) resources including inodes, as they do not share resources with anyone else. Clients reaching or exceeding this limit will be contacted so we can evaluate their needs and if necessary make other plan arrangements.
You may not use your shared hosting account, reseller account or any VPS account for file storage of other hosting accounts, ie: backups, storing backups of DVD’s, mp3’s, movies, gaming files, etc. Large files used in this manner on an active system can lead to file system corruption and lead to not just your own data loss but that of others.
You may not send more than 200 emails per hour, per website, on shared hosting or reseller accounts. Any emails over that limit will be discarded. You may batch the emails to stay within limits. VPS and Dedicated servers are exempt from this limit.
Your account may be provisioned with a monthly bandwidth allowance that varies depending on the hosting plan you order. If your account exceeds the allocated amount we reserve the right to suspend the account until the start of the next month, until you upgrade to a higher plan, or until you purchase more bandwidth. We are very leniant on bandwidth and providing time to find a solution that will work for your needs. Most clients never have high enough bandwidth needs that we have to work on custom plans to fit their needs. Some of our premium accounts offer "unlimited" bandwidth, which means that there is a max limit that has to be set on the server, but the limit is so high most users would ever reach it. If you have "unlimited" bandwidth and are somehow near reaching the high max limit, just email support to set the number higher. If you terminate a VPS or Dedicated Server account you are still responsible and liable for any current usage and associated fees for the overages. Data transfer usage for dedicated servers is calculated using 95th percentile, also known as burstable billing, in order to assist clients from heavy overage penalties should they experience unanticipated spikes in traffic.
Back-ups and Data Loss:
Clients use our services at their own risk. Our server software does create daily backups for your sites that you may download on your own. We do not store this file and it is for your own use should you choose to use it. We perform daily backups on all of our shared servers to ensure critical files are never lost. We provide this costly service free in case of server error, but with no warranty of any kind and only as a courtesy. Any site using more than 25GB space will be removed from the free backup service. We will not restore a file any user has accidentally deleted or modified. The back-up restoration is for server emergency restoration procedures only. You are advised to backup all of your own files to your local computer or additional backup service. If we do have backups available for your files that you need restored, and if we have the ability and time to restore the file(s), there will be a $50 fee for restoring the files. We are not responsible and you agree to not hold us liable for lost data, time, income or any other resource due to server failure, faulty backups or non-existent back-ups or any other hardware or server failure. Backup restoration is NOT a fast process. Due to the volume of data being stored, compression, and network file transfers, decompression, restoration, integrity checks, and other variables, the restoration process of large nodes can sometimes take several days. We highly encourage everyone to purchase their own separate managed backups from one of our backup plans if your site or data is critical to your business or livelihood. Some software installations via softaculous offer automated backups for webfiles and/or databases that stores the backups server side. We recommend copying those backups onto your own local computer/disk as well.
Network and Hardware Up-Time:
Our network has an up-time success rate of 100%! Our data center employs high-quality software and hardware, so you can expect nothing less than 100% uptime for you and your website’s visitors. We cannot always predict the future, but server downtime is usually never an issue. If hardware failure occurs, equipment is rapidly replaced at no cost to you. If you experience any website or email downtime, do send us feedback.
If you are requesting us to register your domain name for you (purchase, transfer or renew a domain names), SupremeWebHosting.net will register such services for you on your behalf and our system should set up name servers automatically; but it is ultimately your responsibility to ensure the correct name servers are set for your domain (ns1.supremewebhosting.net and ns2.supremewebhosting.net). If you use an outside domain name provider, you will have to use their system to point your domain name to our name servers. All domain registrations are NON-REFUNDABLE. You, as the registrant of the new domain, are required to ensure correct whois information is maintained at all times.
EXPIRATION AND RENEWAL OF SERVICES: Domain names are paid up front for one year. It is ultimatley your responsibility to keep your own records and to maintain your own reminders regarding when your domain name registration or other Services are set to expire. With respect to domain name registration services, we (or our provider) will email a renewal notification approximately one (1) month prior to each such domain name’s expiration. In addition, if a domain name is not renewed, we and/or our provider will email additional renewal notifications prior to expiration and again within five (5) days after the expiration of such domain name’s registration. All renewal notifications will be sent to the primary contact email address for the Account associated with the domain name registration. It is your responsibility to maintain current and accurate credit card information should any Services be placed on “auto-renew.” We will notify you when renewal fees are due. Should these fees go unpaid, your Services will expire and your right to use a domain name cancelled. Payment must be made as we may allow or require from time to time. If you select automatic renewal of the Services, we may attempt to renew the Services a reasonable time before expiration, provided your contact information is available and up to date. It is your ultimatley your responsibility to keep your contact information up to date and we are not required to, but may, contact you to update this information in the event that an attempted transaction is not processed successfully. The automatic renewal option is not always available on some domain names.
EXPIRATION OF A DOMAIN NAME REGISTRATION: Immediately after the expiration of the term of domain name registration services and before deletion of the domain name in the applicable registry’s database, we may direct the domain name to name-servers and IP address(es) designated by us, including, without limitation, to no IP address or to IP address(es) which host a parking page or a commercial search engine that may display advertisements, and we may change the contact information in the WHOIS output for the expired domain name so that you are no longer the listed registrant of the expired domain name.
Reactivation Period Process. For a period of approximately thirty (30) days after expiration of the term of domain name registration services, we may provide a procedure by which expired domain name registration services may be renewed. We may, but are not obligated to, offer this process, called the “reactivation period.” You assume all risks and all consequences if you wait until close to or after the expiration of the original term of domain name registration services to attempt to renew the domain name registration services. We may, in our sole discretion, choose not to offer a reactivation period and we shall not be liable therefore. The reactivation period renewal process, if any, may involve additional fees which we and your Primary Service Provider may determine. We may make expired domain name(s) available to third parties or expired domain name registration services may be re-registered to any party at any time.
After the reactivation period, if any, we may:
Discontinue the domain name registration services at any time thereafter without notice. In which case, certain registry administrators may provide procedures by which discontinued domain name registration services may nonetheless be renewed. We will participate in this process, typically called the “Redemption Grace Period” (“RGP”), for each TLD registry administrator that provides it. We may, in our sole discretion, choose not to participate in the RGP process with respect to any or all of your TLD domain name registration services and we shall not be liable therefore. If available, RGP typically ends between thirty (30) and forty-two (42) days after the end of the reactivation period of the domain name services. The current RGP fee for all domains, where applicable, is $250 and does not include the usual registration fees that will be due. We are not obliged to contact you to alert you that the domain name registration to being discontinued or to pay the registry’s registration fee or otherwise provide for the registration services to be continued. In which case, we may then set the name-servers and the DNS settings for the domain name, we may set the DNS to point to no IP address or to IP address(es) which host parking page(s) or a commercial search engine that may display paid advertisements, and we may change the contact information in the WHOIS output for the expired domain name so that you are no longer the listed registrant of the expired domain name. Or we may decide to resell the expired domain name. We do not have to pay you any of the proceeds we may earn as a result. We are not obliged to contact you to alert you that the domain name registration is being continued or resold. The domain name will be designated as being in the redemption grace period (“RGP”), and you will be allowed to assume, during the first 42 days of the then expired registration date, and re-assume complete management of the domain name, including the right to control the DNS settings, provided that you pay the RGP fee plus any registration fees. After the end of the 42 day period, if you do not exercise your rights under this provision, you have abandoned the domain name services, and relinquish all interests and use of the domain name services.
